Subject: 11’ Rear Yard Variance
Petitioner: Charles H. & Janice L. Staley
Location: 1842 Kern Road
ZBA Request: To allow a proposed deck to be 9 feet from the rear property line. The minimum rear yard requirement in an R-1A district is 20 feet.
Background: The property is zoned R-1A with frontage of 120.49 feet and a depth of 98.83 feet on the west side and 99.74 feet on the east side. The petitioner is requesting to construct a 13’ x 15’ deck over an existing patio. The deck would project into the rear yard 15 feet. The current rear yard measured from the back of the house to the property line is 24 feet. The proposed deck would only leave 9 feet to the property line.
Staff’s Observations:
Staff Recommendation: Staff recommends denial of the rear yard variance request.

Petitioner: Richard Allen & Michelle Lynn Beebe
Location: 910 Eldridge Street
ZBA Request: To allow a proposed garage addition (including overhang) to be 3 feet from the property line. The minimum side yard requirement in an R-1 district is 5 feet.
Background: The property is zoned R-1 with frontage of 67 feet and a depth of 300+ feet. The petitioner is requesting to construct a 16’ x 32’ addition to his existing detached garage. The existing garage is 16’ x 22’ and including the overhang is 3 feet from the west property line.
Staff’s Observations:
Staff Recommendation: Staff recommends denial of the side yard variance request.
